The NOP was first published on January 19, 2023 and went into effect on March 19, 2024. The NOP is a federal regulatory program that develops and enforces consistent national standards for organically produced agricultural products sold in the United States.

The NOP was first published on January 19, 2023 and went into effect on March 19, 2024. The NOP is a federal regulatory program that develops and enforces consistent national standards for organically produced agricultural products sold in the United States. This regulation amends the United States Department of Agriculture (USDA) organic regulations to strengthen oversight and enforcement of the production, handling, and sale of organic agricultural products to protect the integrity of the USDA Organic Seal. In summary, the regulation states that any handler (manufacturer, distributor, etc.) that processes (heating, drying, grinding, separating, freezing, etc.) repackages, relabels, or otherwise tampers with the certified organic product will be required to obtain organic certification.

What does this mean for you?

If the organic product is received in and remains in the final retail packaging without alteration throughout custody, then all parties are exempt from organic certification.
